These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms "we", "us" and "our" refer to booked2fly.com. The term "Principal" refers to travel industry, the term "you" refers to the customer visiting our website, booking a reservation through us or otherwise using our services
Website Contents Unless otherwise noted, this website, and all materials on this website, including text, images, illustrations, designs, icons, photographs, video clips and other materials, and the copyrights, trademarks, and/or other intellectual property in such materials (collectively, the "Contents"), are owned, controlled or licensed by Booked2Fly Services.
This website and the Contents are intended solely for personal, non-commercial use. You may download or copy the Contents and other downloadable materials displayed on this website for your personal use only. No right, title, or interest in any downloaded Content is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the Contents of this website.

You may register with us when utilizing this website or by other means. For your website account, you are responsible for maintaining the confidentiality of your account username and password and for preventing unauthorised access to your account. Access to use the website
You warrant that :
You are at least 18 years of age; and you possess the legal authority to create a binding legal obligation; you will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act; you will inform such other persons about the Terms and Conditions that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto; We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions.
Booking Enquiries & Reservations
Once the Client has filled in all applicable fields to initiate an enquiry regarding a particular destination, trip, tour or mode of travel on the Travel Agent's website www.booked2fly.com ('Website'), or has responded to an advertisement verbally or in writing, via e-mail or the internet or has, without reference to any of the aforesaid, asked for more details telephonically (collectively referred to as 'the Enquiry'), the Website, or the Travel Agent will prepare and provide the Client with an estimated cost of the Enquiry (online, by e-mail or telephonically) ('the Estimate'). This Estimate is accepted by the Client when the Client proceeds with the steps as specified on the Website or accepts the Estimate verbally over the phone or via email. Full payment of the total value of the Estimate ('the Price') as specified in the Estimate is required in order to confirm reservations with Principals ('the Booking'). Once the online Booking or Booking affected by the Travel Agent has been completed and the Client has authorized booked2fly.com to process the payment by submitting the Booking for reservation, the Client will be supplied with an email that will contain the final details of their Booking ('the Booking Confirmation Form'). In the case of air tickets, full payment for the Booking needs to be made by midnight US time on the day that the Booking was made in order to guarantee the fare quoted according to the Booking Confirmation Form.
Our Agreement with You
We sell a variety of travel related products from different suppliers and service providers ("Suppliers"). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. Our website, which is referred throughout this Agreement, can be found at www.booked2fly.com.
booked2fly.com acting as intermediary or a "Booking Agent" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.
All airlines tickets are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by booked2fly.com to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. Acceptance of these terms and conditions hereby consent you to any post-purchase price increases and authorize booked2fly.com to charge my credit card for such additional amounts.
Your Agreement with Us
By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including Our Agreement with You sentence above of this Agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation. By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including Our Agreement with You sentence above of this Agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due.
You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.
You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.
Payment and Payment Terms
The full payment is due immediately by Visa, Master Card, American Express, Electronic Funds Transfer or Cash Deposit at a bank, whichever is applicable. If the full payment is not received on time on the day that the Booking was made, the Travel Agent or Third Party Service Provider (as the case may be) involved reserves the full right to cancel the Booking. In the event that payment has been made after the aforementioned deadline, the Client will be liable for any difference in price should the Client still want to proceed with the Booking at the higher price.
booked2fly.com is a USA company and all transactions are processed in United States Dollars. All payments shall therefore be made in the equivalent local currency in accordance with the prevailing conversion rate as published from time to time by the Agent. Therefore conversion charges may be levied by your merchant bank if payment is made from another country and/or in another currency other than United States Dollars. This fee is driven by the global treasury of the applicable credit card and is impacted by the change in daily exchange rates.
Prices
Prices are quoted at the ruling daily exchange rate. Until the Travel Agent has received payment of the Price in full, it reserves the right to charge any fluctuations to the Client's account and the Client undertakes to pay for any such fluctuation on demand. The onus will be on the Client to check that there have been no changes in the Price prior to making full and final payment. Airfares are subject to the price and conditions quoted by the airlines.
However, once payment of the Price in full has been received, the Price is guaranteed provided that the payment was made by midnight on the day that the Booking was made. Should the Client be a group booking and the group number deviates from the number required for the Booking, the Principal may reserve the right to re-cost the Price and raise a surcharge. Should any Client refuse to accept and pay such surcharge, it may result in the Principals cancelling the Booking and retaining any payment made. (The Travel Agent will be entitled to retain any service fees charged).
Service Fee
These fees cover the costs incurred by the Travel Agent in booking and servicing your travel reservation.
Cancellation
In the event of the Client cancelling the Booking, the Travel Agent shall have the right to either claim an amount or to retain an amount of the payment and claim damages suffered by the Travel Agent. The Principals may reserve the right to cancel any services prior to departure, in which event the entire payment for the ticket will be refunded to the Client without any further obligation on the part of the Travel Agent.
The Travel Agent will charge a fee for processing the request for refund. (Clients should refer to the 'Refunds' section of these Conditions, as well as the cancellation provisions contained in the Principal's Conditions and Website. Principals may charge cancellation fees over and above these stated here).
Cancellations and Changes
Your contract with your Suppliers may allow them to cancel or amend bookings. If we are your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier's terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.
If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave the United States, we will contact you by email to advise you of this. Please ensure that you have given your contact email address to us and that you regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes.
After you have left the US, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight to do this. Please note that for some airlines it is mandatory to confirm with them your intention to fly.
If You Change Your Booking
Where a change requested by you to your travel arrangements is permitted and possible, our standard service fees will apply in addition to any additional Supplier charges. Please contact your original booking agent to enquire about changes or review the 'Travel Help' section of www.booked2fly.com for details of how to request changes. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.
Changes to name details are not allowed by many airlines and other Suppliers. While we will endeavor make such a change if necessary, please bear in mind that most airlines and Suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.
Flights must be taken in the sequence they appear on your ticket or eticket confirmation. If you plan not to take a flight as booked, please contact the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a 'no-show', which could result in extra charges and/or your whole flight itinerary being cancelled and/or render your ticket void.
If You Cancel Your Booking
If you cancel your arrangements, you may be entitled to a partial refund. In addition to the cancellation terms and conditions of your Supplier(s), our standard fees will apply as may be outlined on your receipt or booking confirmation. We need to receive from you your original voucher before any applicable refund can be considered. If you decide to cancel arrangements before the balance due date, any deposits paid are non-refundable.
Refunds will only be paid to you once we have received the funds back from the Supplier(s). Generally flight tickets cannot be refunded if they are partially used. We are not responsible for a Supplier's failure to pay a refund. If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.
Foreign Exchange Regulation Compliance
Foreign Exchange Regulation Compliance is the Client's exclusive duty. This will apply especially when the Client instructs the Travel Agent to make and pay for travel arrangements on the internet.
Electronic Ticketing (e-tickets) booked2fly.com uses electronic tickets (e-tickets) for all flights. Your reservation and ticket data are automatically transferred to the airline's reservation and management system. Upon issuance of a ticket, you will receive an e-mail which includes your ticket number for your 'e-ticket', which must be printed and used for check in at the airport. Your name in the reservation system MUST match your identity and identification documents used for travelling. If you are travelling with more than one passport the ticket must match your travelling passport. Failure to correctly enter data for names or passports used for travel is the passengers responsibility and booked2fly.com has no liability for errors or omissions on any booking details entered or not entered into for a booking.
Internet Bookings
If the Client requests or instructs the Travel Agent to affect bookings via the internet, the Client irrevocably authorizes the Travel Agent to do the following on its behalf (1) make any selections of and for the Proposed Travel Arrangements (2) make payment of a booking and ancillary services and (3) accept booking conditions.
Baggage
booked2fly.com uses information provided by suppliers to identify the possible baggage allowance available to the traveler based on fare basis, class of ticket, and airline. booked2fly.com has no liability for correctness, errors, or omissions on any booking relating to baggage allowances. Airlines and suppliers have reserved the right to change baggage policies without notice to suit business and operational needs. Please note that international and mixed carrier flights may have differing baggage allowances. International departures and arrivals to and from North America, when in combination with domestic North America flights, may require additional baggage fees, not quoted by booked2fly.com, to be paid upon departure. booked2fly.com has no liability for any baggage fee's charged at check-in for any flight on any airline, rail, or cruise travel.
When there are two or more airlines involved for connecting flights then you may have to claim your bags at the connecting airport and check-in again to continue your journey. You are also advised that in these cases if you have excess baggage, where there is a difference in baggage allowance from one carrier to the next, you will have to pay an excess baggage fee assessed by each airline. Most USA airlines and a growing number of international and domestic carriers now charge baggage fees even for the first bag checked. Our display of a baggage allowance on the search page and on any issued ticket is subject to the acceptance of the airline as to it being correct. We publish the airlines filed baggage allowance for the fare, class, and route. Airlines have the right to change baggage policy and fees without notice. Baggage fees range from 15 USD up to 100 USD or more depending on the size and weight of the bag and are per checked bag. Excess baggage fees are calculated by the kilo or by the piece depending on the airline. Any additional fees for baggage not purchased at the time of booking from the booked2fly.com website are to be paid directly to the airline upon using such service.
Refunds
No refunds will be considered in any circumstances whatsoever by the Travel Agent. Refunds by the Principals will be subject to their respective terms and conditions. The Travel Agent may charge a fee for processing a request for refund. Principals may charge refund fees above those stated here. Documentation
Our general practice is to send documents to our customers electronically whenever possible. We reserve the right to charge an administration fee should you makes a request for such documents to be sent as a hard copy. Important Notice Regarding Airline Reservations
If you arrive at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservation for you – do not leave the counter. Check your ticket. If the status box shows "OK" for the flight in question, the airline policies typically require them to accommodate you on that flight, or if that is not possible, they must either find you a substitute flight or pay you denied boarding compensation. If necessary ask to speak to a supervisor.
Complaint If you have a problem during your holiday, please inform the relevant Supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us, either through the office where you made your arrangements, or through booked2fly.com. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement. We are a member of the Better Business Bureau.
Travel Documents and Destinations It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc. Prior to booking international travel, we recommend that you review any U.S. Government's prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.
You further agree that in connection with your activities, you will not permit the use of our services or website by anyone that resides or is staying in a country for which such use is prohibited under U.S. regulations.
Passport, Visa and Immigration Requirements It is your responsibility to fulfill the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
You are also required to carry a valid International Student I.D., and International Youth I.D. or an International Teacher I.D. card if you are traveling on a special student/youth/teacher ticket. It is your responsibility to verify this with our travel expert who is assisting you. Insurance
Travel insurance is a vital part of your arrangements. We strongly recommend that you have taken out adequate insurance for the duration of your journey. Travel insurance is a mandatory element of some travel arrangements. We may be able to arrange travel insurance to be provided to you, furnish you a quote, and answer any queries you may have regarding the insurance.
Travel Advice and Vaccinations
U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.
Airline use of Insecticide Spray
Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: paints, lighter fluid, fireworks, tear gases, oxygen bottles and radio-pharmaceuticals.
There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Intellectual Property Rights Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, booked2fly.com owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to booked2fly.com without obtaining authorization from booked2fly.com. Notwithstanding the foregoing, it is expressly clarified that you will retain ownership and shall solely be responsible for any content that you provide or upload when using any Service, including any text, data, information, images, photographs, music, sound, video or any other material which you may upload, transmit or store when making use of our various Service. Access and Use This Website is offered to the Client on condition that the Client accepts, without modification, the terms, conditions, and notices contained herein. The Client's use of this Website constitutes the Client's agreement to all such terms, conditions, and notices.

Whilst the Client may make limited copies of the Client's travel itinerary (and related documents) for travel or services purchased through this Website, the Client agrees not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Website.
